Union Pacific Blocking Fremont Streets

A Union Pacific Railroad freight train is presently stopped at Niles Junction and blocking the crossings at Walnut and Stevenson.  The train has been there since 4:15 p.m. and the engineer has  been trying to contact their dispatcher on the radio without success.  A Fremont Police officer inquired with dispatch if they were aware of the train blocking streets.  She said they were and had been in contact with UPRR.  Then the train dispatcher calls the train at 4:33 saying there is an Amtrak in the way and she will move them when she can.  The question is, had the dispatcher answered the train in a timely manner, would it have been moved beyond Niles Junction in a timely manner and not block city streets?  I believe there is a ten minute time limit and then the railroad could face penalties.  Normally if there is going to be a delay at the junction, the trains are held at the golf course prior to Stevenson so as not to block trains.
